Public Notice for the Homebuyers of Unitech Group

Final and Last opportunity for Change of Option from Refund to
Possession (along with the attendant conditions)

  1. 1.

    Pursuant to the publication of lists of refund seeking Homebuyers vide Public Notice 12th September 2024, a number of emails have been received from the Homebuyers (and the process of receipt of emails to this effect is still continuing) that they missed out on the opportunities given earlier and that they would like to change their option now from Refund to Possession. Some of them have also filed IAs in the Hon’ble Supreme Court requesting for giving them another opportunity to change their options.

  2. 2.

    Keeping in view the requests from left-out Homebuyers, the matter has been considered by the Government appointed Board of Directors in its meeting held on 13.11.2024 and it has been decided to give one more, but last and final opportunity to the Homebuyers to change their options from Refund to Possession. This window of change of option will remain open in the on-line mode only for a period up to 31.12.2024.

  3. 3.

    Exclusions:
    The Homebuyers who have already received the full refunds of the principal amount deposited by them, either from the Unitech or on grounds of Medical Exigencies based on the orders of the Hon’ble Supreme Court, cannot avail of this option as their Units have become part of the unsold inventory of Unitech as per the directions of the Hon’ble Supreme Court.

  4. 4.

    In order to be eligible for Change of Option from Refund to Possession, the concerned Homebuyer has to fulfil the following conditions:

  5. (i)

    Each of the Homebuyers, who wish to change his/her option from Refund to Possession, has to first update his/ her contact details on the website of the Company in online mode;

  6. (ii)

    The Homebuyers who have availed of partial refunds earlier and who now wish to change their option to Possession, would have to upfront pay the partially refunded amount in full along with 9% interest calculated from 16.02.2024 till the date of payment in terms of the directions contained in para 6 of the Hon’ble Supreme Court orders dated 03.11.2023;

  7. (iii)

    The Homebuyers of Projects where works have already commenced and demands have been raised for payment of the balance dues as per the Revised Payment Plan, would have to make payment of the overdue amount either upfront or in two equal instalments (one with the Change of option and the second within three months thereof) along with interest calculated @ 9% on the amount due from the due date of payment of the respective instalment till the date of payment;

  8. (iv)

    The change of option would be subject to the condition that once they request for change of option from Refund to Possession and so allowed, they would forego all their claims qua any interest or delay compensation, notwithstanding any decree in their favour from any Court/ Forum allowing such claims in the past;

  9. (v)

    As regards the Homebuyers of Anthea Floors Project in Gurugram, they will be required to complete the above conditions and also submit their Consent (format of the Consent is available on the website) regarding the revised floor plans in view of current bye-laws and government regulations, consequential additional costs and consolidation of the constructed floors as against their originally allotted numbers. This Consent is to be sent as an attachment along with the email to the designated email id: antheafloors@unitechgroup.com within the given timelines.

  10. (vi)

    All requests for Change of Option will have to be submitted in on-line mode only and sent only to the designated email id refundtopossession@unitechgroup.com so as to avoid any ambiguity in adhering to the timeline for submission of documents in physical form. However, in cases where Homebuyers visit the Unitech office in person in view of their constraint to upload the information/ documents/ request as they are not IT-savvy, the Unitech staff will facilitate completion of the on-line transaction for them within the time frame provided; and

  11. (vii)

    Please avoid submitting your requests at the last minute of the deadline as there is no scope for Change in Option after 31st December 2024.

  12. (viii)

    Please also retain a copy of the email in your records for any future reference.

  13. 5.

    Important to note that even those homebuyers who have filed Intervention Applications before the Hon’ble Supreme Court in this regard should also exercise their option to change now itself, irrespective of filing of their application, since after completion of the timelines provided herein, the management shall proceed to finalise the unsold inventory.

  14. 6.

    Entire process including updation of contact information, communication of intention to change the option from refund to possession to the designated email and deposit of partially refunded amount along with interest should be made on or before 31st December, 2024 for availing this last chance being given to all the homebuyers.

Expressions of Interest (EoI) for Engagement of Agencies

for the Management of Waste Material
at Unitech’s Commercial Complexes in Gurugram
  1. 1.

    The Unitech Group has 18 Commercial Complexes in Gurugram, a list whereof is annexed at Annexure-A. At these Commercial Complexes, a bulk quantity of waste material is generated which inter-alia include (i) Wet Waste (Kitchen Waste), (ii) Dry Waste, consisting of paper, paper card board, plastic, iron scrap etc., (iii) Domestic Hazardous Waste, (iv) Sanitary Waste, and (v) E-waste, among others.

  2. 2.

    Through this Public Notice, the expression of interest is invited from eligible agencies, empaneled with the Municipal Corporation, Gurugram (MCG), for the collection and disposal of waste material in tune with the Government instructions. The selected agency shall be responsible to provide a statutorily-acceptable and environmental-friendly solution in accordance with the Solid Waste Management Rules of 2016, instructions issued by the Central Pollution Control Board (CPCB), National Green Tribunal (NGT) or any other statutory Authority, as applicable, from time to time. The agency shall also be required to upload the requisite data on the portal of all the statutory authorities, like, CPCB, NGT, MCG and others.

  3. 3.

    The Agency shall adhere to all statutory guidelines as appliable and provide a holistic solution for the collection of Bulk Waste Material, disposal of the same in accordance with the applicable laws, rules and regulations and uploading of periodic reports on the portals of all the statutory authorities either itself or through a qualified agency as per the guidelines and timelines prescribed for the purpose, on daily, weekly, fortnightly, monthly, and yearly basis through an Innovative Mobile App so that the data seamlessly integrates with the designated portals of Municipal Corporation, CPCB Reporting System, GMDA, and other authorities designated by the State or Central Governments.

  4. 4.

    The selected Agency should be empaneled with the Municipal Corporation, Gurugram or should have a tie-up with any Municipal Corporation Empaneled Agency.

Public Notice

for the Homebuyers of Unitech Group

Updation of Contact details and other particulars in Unitech’s portal
  1. 1.

    It is informed that the new Management appointed by the Union of India, with the prior approval of the Hon’ble Supreme Court, vide its order dated 20.01.2020, had decided to interact with all its homebuyers only through electronic mode, since it is manually not possible to communicate with thousands of homebuyers in physical mode. Further, taking note of the fact that the contact details furnished by the Homebuyers at the time of booking their Units may have become obsolete over the years, the Management created a facility on its website under the tab Contact updations on the Homepage to enable the Homebuyers to update their contact details. Public notices have been uploaded on the website from time to time requesting the Homebuyers to update their contact details on the website.

  2. 2.

    The idea is to create Email Groups and WhatsApp Groups of the Homebuyers of each project so that any development can be communicated to the concerned. As such, it is critical that we have the latest Address, Email ID and the Mobile No. of the concerned Homebuyer updated in the system at all times.

  3. 3.

    However, it is a matter of serious concern that only 9,609 homebuyers, out of a total of 16,450, have so far updated their contact details in the system. As a result, we still have about 7,000 odd Homebuyers who have to update their contact details. As a result of this, it is becoming increasingly difficult to reach out to such Homebuyers. As a matter of fact, it also raises a question about the existence of any such Homebuyer.

  4. 4.

    Accordingly, the homebuyers are once again requested through this Public Notice published in various newspapers to update their Contact Details and other particulars, on the Company’s web-portal (https://connect.unitechgroup.com) or visit the tab under Contact Updation in the Company’s website (https://www.unitechgroup.com) on or before 30th November, 2024. In case of any difficulty, they may either visit the Unitech office or contact Mr. Tanmoy Prasad, General Manager, IT Division at his email id tanmoy.prasad@unitechgroup.com

  5. 5.

    It is made clear that the homebuyers who still fail to update their Contact Details on or before 30th November, 2024, the Management may be left with no option but to take recourse to cancellation of allotment of their respective Residential and/ or Commercial Units without any further notice along with forfeiture of the consideration amount paid by them. In subsequence thereto, the new Management may also contemplate to initiate the due process under the provisions of the Benami Transactions (Prohibition) Act, 1988 and the rules made thereunder.

Details of the Refund Seeking Homebuyers of Unitech Group

Public Notice

  1. 1.

    This is in continuation of the Public Notices dated 06.11.2023, 19.12.2023 and 03.05.2024 uploaded on the website of the Company for the Homebuyers of Unitech Projects for the change of Option from Refund to Possession. These notices, along with all the relevant facts and background on the subject contained in the last notice dated May 03,2024, are still available on the website and can be accessed/ referred by the concerned Homebuyers.

  2. 2.

    Having gone through this process in accordance with the directions of the Hon’ble Supreme Court issued from time to time, we find that a total of 12,130 Homebuyers had registered themselves on the portal, out of which 4,576 Homebuyers had opted for Refund on the Amicus’ Portal created pursuant to the directions contained in the Hon’ble Supreme Court Order dated 15th September 2017 and 21st September 2017. A total of 1,954 Homebuyers have changed their option from Refund to Possession pursuant to the directions of the Hon’ble Supreme Court issued vide its orders dated 17.08.2021 and thereafter vide its orders dated 03.11.2023 till the last date i.e. 31.05.2024.

  3. 3.

    As a result of the above, we have a total of 1,657 Homebuyers, who have not changed their options during the period granted for the purpose. The details of these Refund Seeking Homebuyers are being uploaded on the website through 03 Lists as under:

  5. 4.

    Though every care has been taken that all such Homebuyers who had changed their options from Refund to Possession are duly treated as the Possession seeking Homebuyers, the possibility of missing out any name cannot be ruled out. As such, these lists, which contain the Project-wise details of Refund seeking Homebuyers, are being uploaded so as to give an opportunity to the Homebuyers to point out if they have at any stage communicated their change of option, along with the attendant conditions, within the given timelines. The Management is not in a position to extend the date for Change in Option any further on its own accord as the unsold inventory cannot be kept open-ended.

  6. 5.

    In case any Homebuyer, included in the lists now uploaded on the portal, claims that he/ she had changed his/ her option which has not been considered, such Homebuyer may escalate the issue along with supporting document i.e. the email vide which such change of option was communicated to the Company/ Management on the dedicated email ID refundtopossession@unitechgroup.com before 31.05.2024 to the email ID, changeofoption@unitechgroup.com within a period of 30 days i.e. by or before 15.10.2024. This is the final opportunity for any corrections in these lists.

Updation of Contact details and Payment of Due Amount

Dear Homebuyers,

We have received emails from various Homebuyers seeking updates on the commencement of construction on various projects in respect of which contracts have been awarded. We are in the process of evolving a system whereby we would be uploading the status of important milestones, on a periodical basis on the website. It should be possible to do so by the end of February 2024. It will be under the Tab “Status updates on Projects” on the Homepage. A homebuyer would be able to see the latest update by clicking on the drop down menu – (a) Location, (b) Project and then (c) Sub-project.

I also take this opportunity to share some road-blocks that we are facing and which can be easily addressed with your active help and cooperation. These are as under:

1. Customer Database – register on the “Contact Updation”

  1. (i)

    As per our database, there are a total of about 16,450 Homebuyers, comprising 14,936 residential units and 1,514 commercial Units, across all projects to whom possession of Units is to be delivered after completion. Pursuant to the directions of the Hon’ble Supreme Court vide its order dated 15.09.2017 about 12,130 Homebuyers had registered themselves on the portal developed by the Amicus Curiae, which has also become dated and obsolete. As 01.02.2024, we have the contact updates (Address, email ID and Mobile Nos.) of only about 7,595 Homebuyers. As a result, we are finding it extremely difficult to effectively reach out to all the Homebuyers.

  2. Hence, the request to all the Homebuyers is to kindly update their contact details on the Unitech portal using the Tab “Contact Updation”
  3. (ii)

    It has been experienced that individual emails are being sent by a large number of Homebuyers for contact updations rather than doing the same through the system developed for the purpose. The IT team has been assisting a good number of them who face any difficulty in operating through the system. Typically, the errors are on account of mismatches with the customer database of Unitech, which is based on the data inputs on the Allotment Letters, be it your name, Customer Code, your Unit Identity or other fields. Hence, it is advisable that you keep the copy of your Allotment Letter by your side when you are updating your contact details. This would help minimise any problems.

2. Timely Payment of Instalments of the Balance Dues

  1. (i)

    The Homebuyers are required to make payment of the balance dues in quarterly instalments as per the Revised Payment Plan in terms of the directions of the Hon’ble Supreme Court vide its order dated 03.11.2023 (order available on the website). The Management has decided to raise demands from the Homebuyers of only such projects (excluding Noida based Projects) where the Contracts have been awarded. The due date of payment of the First instalment was 10.01.2024.

  2. Hence, the request to all the Homebuyers is to kindly update their contact details on the Unitech portal using the Tab “Contact Updation”
  3. (ii)

    It is disturbing to Note that as against the due amount of Rs. 97.35 Crore as on 10.01.2024, we have received payment of only an amount of Rs. 27.40 Crore (i.e. 28.15%) as on 31.01.2024. Here also, the payments vary across the projects. For instance, in the case of Greater Noida based 05 projects, where a total of 1222 Units are to be completed and delivered to the Homebuyers, all contracts have been awarded, the contractors have mobilised at sites and works have commenced. The works in the case of Habitat project would be commenced only after the Environmental Clearance is received, which is expected shortly. However, against the amount of Rs. 17.94 Crore due for payment on 10.01.2024, the Homebuyers of Greater Noida projects have paid an amount of Rs. 1.81 Crore only (i.e. 10.09%).

  4. (iii)

    All the Homebuyers, we are sure, would appreciate that it will not be possible for us to carry on with the construction activities if the cash-flows from the Homebuyers are short of the due amounts.

  1. The Hon’ble Supreme Court has directed vide para 6 of its Order dated 03.11.2023 as under:

    “As regards payments by the home buyers, we issue the following directions:

    1. (i) The home buyers who have opted for possession of constructed units shall make payment of their balance dues in accordance with the revised payment plan which has been uploaded on the website of Unitech Limited, failing which interest shall be payable at the rate of 9%per annum.”
  2. Homebuyers, whose Units are part of 39 Projects as per the List-A of 39 projects for which contracts have been awarded, can view their Ledger, Total Amount Due and the Payment Schedule along with due date of payment at Contact Updations Tab on the homepage http://www.unitechgroup.com. All the Homebuyers have to pay the installment as per the revised payment schedule/ due date through online payment system developed for the purpose. Payment can be made through NEFT/ RTGS, Internet Banking or UPI. You may kindly refer to the Procedure Manual-1 for detailed steps to be followed for performing the above activities.   3. In case the installment is to be paid by a Bank/ Financial Institution on behalf of the Homebuyer, the Homebuyer shall generate the Challan for NEFT/ RTGS payment mode. The same can be submitted to the Bank/ Financial Institution for making payment. Payment made to the account number mentioned in the Challan will be automatically credited to your account. You can also download the receipt from the system.
  4. Kindly note that the payment of first Installment shall be made by 10.01.2024. Delay in payment will attract Interest @9% per annum on the amount of default for the period of default.
  5. As per the Hon’ble Supreme Court directions dated 03.11.2023 para 6 (iii), Homebuyers who change their options from Refund to Possession and who had received partial refunds earlier through the Registry/ Ld. Amicus Curiae, would have to repay the principal amount which was earlier refunded to them within a period of eight (8) weeks of their opting for possession. Accordingly, all repayment has to be made by 15.02.2024 without fail. Homebuyers, whose Units are part of 39 Projects (List - A) for which contracts have been awarded and who change their option from Refund to Possession will have to pay the refunded amount through online portal developed for Homebuyers. Using the portal, Homebuyers can make payment of the amount through NEFT/RTGS, Internet banking or UPI.
  6. Homebuyers, whose Units are situated in projects other than the above mentioned 39 projects, shown here as List-B, can make payment through another portal, against the project Click here to access the List B Refund. Click here to access the Portal
  7. The Revised Payment Schedule in respect of Homebuyers of Four projects of Noida has not been generated keeping in view the pendency of approvals from Noida Authority. The Payment schedule in respect of these four projects will be generated as soon as approvals are granted. A notice will be published for the Homebuyers of these four Noida based Projects separately.

The list of 220 eligible Homebuyers whose refunds have been approved by the Hon’ble Supreme Court on grounds of Medical Exigencies vide its order dated 13.10.2022 (Annexure 12 of Justice A M Sapre report ) is hereby uploaded on the Unitech Portal Under Refund Claims on Medical Grounds tab.

The procedure to be followed by the concerned Homebuyers for seeking refund is mentioned in the Notice placed on the same tab.

Notice to Fixed Deposit Holders

Refunds to FD Holders on grounds of medical exigency, as approved by the Hon’ble Supreme Court vide its Order dated 01.02.2023 on the recommendations of Justice (Retd.) A.M. Sapre

It is hereby notified for the information of all such FD Holders to whom the refunds have been approved by the Hon’ble Supreme Court on the grounds of Medical Exigencies vide its order dated 01.02.2023, that payments shall be made upon submission of documents, as mentioned in detail (Click here for detail). The List of FD Holders who has been found eligible is uploaded on portal.

It may be noted that the list being uploaded now has been cleaned up to take care of multiple/ duplicate entries/ correction of names etc.

For information of FD Holders and Homebuyers who have applied for Refunds on grounds of Medical Exigencies in terms of Hon’ble Supreme Court Orders dated 27.04.2022, 18.05.2022 and 17.08.2022

  1. The Lists of FD Holders who have applied for refunds on the grounds of Medical Exigencies have been uploaded on the portal and virtual hearings in those cases will continue up to 20.09.2022.
  2. The lists of Homebuyers who have applied for refunds on grounds of Medical Exigencies has been uploaded on the portal today i.e. 16.09.2022, along with the schedule of virtual hearings by Justice (Rtd.) A.M. Sapre in respect of cases mentioned in List-A.

Accordingly, the concerned Homebuyers are requested to make it convenient to attend the Virtual hearings as per the dates and time slots given in the List. The Links for the virtual hearing will be sent to them through SMS and Whatsapp on their registered phone numbers the previous day.
