Public Notice for the Homebuyers of Unitech Group

Final and Last opportunity for Change of Option from Refund to Possession (subject to fulfillment of requisite conditions)

Dear Homebuyers,

  1. 1.

    Pursuant to the publication of lists of refund seeking Homebuyers vide Public Notice 12th September 2024, a number of emails have been received from the Homebuyers (and the process of receipt of emails to this effect is still continuing) that they missed out on the opportunities given earlier and that they would like to change their option now from Refund to Possession. Some of them have also filed IAs in the Hon’ble Supreme Court requesting for giving them another opportunity to change their options.

  2. 2.

    Taking into consideration these IAs during the hearing held on 16.09.2025, the Hon’ble Supreme Court has directed as under:

At this juncture, we are informed that some of the home buyers have applied to grant them a fresh option for taking possession of the dwelling units purchased by them in place of the refund for which they have earlier opted. It is pointed out that sufficient opportunities were granted to them in the past. However, Unitech has been persuaded to place the matter again before its Board for sympathetic reconsideration of the requests received from all those home buyers, who had earlier opted for refund. The home buyers who opted for refund may be granted one final and last opportunity to reconsider their previous options and submit the fresh ones. They may be given a one-time option by the Board by fixing a cut-off date for inviting such claims. Thereafter, no such request shall be entertained.”

Notice for the Homebuyers of Unitech Group

Subject: Clarification regarding rate of Goods and Services Tax (GST) applicable for Unitech Construction Services

Dear Homebuyers,

  1. 1.

    We have been receiving queries from the Homebuyers related to recent GST revision effective form 22.09.2025. We have consulted with the concerned experts and this is to inform you that there is no change in the billing rate for Unitech’s construction services. The prevailing rate of 12% (with Input Tax Credit) will remain in force for all Unitech Group on-going projects.

  2. 2.

    It is also relevant to inform that the erstwhile management has opted for 12% GST rate with input tax credit on all on-going projects w.e.f. 01.04.2019 when the Government had notified for either availing 5% GST rate without ITC or 12% GST rate with ITC for residential and commercial construction. Therefore, under the present regulations, the new management is bound to carry on the same rate of GST @12% (with ITC). As such GST rate of 5% is not applicable to Unitech Group for on-going projects.

  3. 3.

    To provide further clarity on the tax structure, please be informed of the following breakdown as per government regulations:

  4. (i) The gross GST rate on construction services, as per Notification No.11/2017-Central Tax (Rate) dated 28.06.2017 and its subsequent amendments is 18%.

Public Notice

for
the Shareholders of Unitech Limited

Dear Shareholders,

You have been voicing your concerns regarding the trading of Unitech shares in Z category as against B category for all these years since the new Management stepped in.  A good number of you have been raising the issue of payment of Listing Fees to both the Stock Exchanges notwithstanding the fact that we have been informing you that the Government appointed Board of Unitech has been regular in payment of the Listing Fees to both the Stock Exchanges. However, we have been consistently taking up the issue of waiver of fines and penalties, levied on account of non-compliances inherited from the erstwhile management, and movement of the scrip of the Company from “Z” category to “B” category, with the SEBI, the National Stock Exchange of India (NSE) and the Bombay Stock Exchange (BSE). The fines and penalties levied on account of such non-compliances by the BSE and the NSE were to the tune of Rs. 3,33,09000/- and Rs. 3,56,69,040/- respectively.

The Government appointed Board is pleased to inform that, favourably considering the representations from the new Management, the SEBI, the NSE and the BSE have very graciously agreed to waive off the said fines and penalties. We are beholden to these institutions for accepting our representations.

Further, the NSE vide its Circular bearing No. 1851/ 2025 (Click here to view) dated 26.09.2025 has also decided to transfer the trading of securities of the Company from “BZ” series to “EQ” series with effect from 07.10.2025. The BSE vide Notice No. 20250926-46 (Click here to view) dated 26.09.2025 has notified that the securities of Unitech Limited will be moved out of “Z” category to “B” category with effect from 07.10.2025. The Notices received from the NSE and BSE are also being uploaded on the website for kind information of all the shareholders.

Subject: Concerns regarding default in payment of Instalments of balance dues by the Homebuyers – reg.

Dear Homebuyers,

  1. 1.

    The Government appointed management of Unitech has repeatedly approached the homebuyers with requests to ensure timely payment of their balance dues in instalments as per the Revised Payment Plan, duly approved by the Hon’ble Supreme Court vide its order contained in para 6 of its order dated 03.11.2023. Needless to say, the management has been raising demands for payment of dues only in respect of projects where construction has commenced on ground.

  2. 2.

    While the payments by the Homebuyers of certain projects is found to be encouraging, it is equally disappointing in certain others. Taking stock of the status of demands raised and the payments made by the homebuyers as on 31.05.2025, it has been found that as against the demand of Rs. 613.20 Crore, the payments received from the Homebuyers are of the order of Rs. 392.45 Crore, leaving an unpaid gap of Rs. 220.75 Crore. This makes the task of uninterrupted pace of construction and timely payment of running bills of the Contractors extremely challenging.

  3. 3.

    The fresh demand of dues as on 10.07.2025 has been worked out to Rs. 187. 62 Crore. Thus, the management should be receiving an amount of Rs. 220.75 Cr. + Rs. 187.62 Cr. = Rs. 408.37 Crore. The list of project-wise total demand raised and the payment received is being enclosed and placed on the Company website in the Public domain as part of the transparency that we have been maintaining.

  4. 4.

    It may kindly be appreciated that the need for Contractors’ payments is bound to be upscaling with every month if the pace of construction is to be maintained/ augmented. So far, we have been managing it reasonably well but we need your support to maintain the same.

  5. 5.

    We are not publishing the names of individuals who are defaulters for maintaining their privacy for the present but strongly urge that they may clear their default during the next one month. However, in case this situation continues, we will be left with no option but to publish their names in the Public Domain and will also be constrained to initiate the process of cancellation of their allotments. We would like to avoid such extreme steps as far as possible.

Subject: Status updates of various projects – reg.

Dear Homebuyers,

  1. 1.

    We have been receiving emails from some groups/ individual Homebuyers to know the status updates on the projects where they have booked their Housing/ Commercial units and construction works have been commenced. As per the feedback received from a cross-section of the Homebuyers, they expect to know the status updates on the project in which they have booked their Units before the due date of payment of instalments. We respect this feedback as it would give them (the Homebuyers) the required confidence in making timely payments.

  2. 2.

    The management has streamlined the system so as to ensure that the homebuyers do not have to send email requests on this account. Please take note of the following schedule:

The list of 220 eligible Homebuyers whose refunds have been approved by the Hon’ble Supreme Court on grounds of Medical Exigencies vide its order dated 13.10.2022 (Annexure 12 of Justice A M Sapre report ) is hereby uploaded on the Unitech Portal Under Refund Claims on Medical Grounds tab.

The procedure to be followed by the concerned Homebuyers for seeking refund is mentioned in the Notice placed on the same tab.

Notice to Fixed Deposit Holders

Refunds to FD Holders on grounds of medical exigency, as approved by the Hon’ble Supreme Court vide its Order dated 01.02.2023 on the recommendations of Justice (Retd.) A.M. Sapre

It is hereby notified for the information of all such FD Holders to whom the refunds have been approved by the Hon’ble Supreme Court on the grounds of Medical Exigencies vide its order dated 01.02.2023, that payments shall be made upon submission of documents, as mentioned in detail (Click here for detail). The List of FD Holders who has been found eligible is uploaded on portal.

It may be noted that the list being uploaded now has been cleaned up to take care of multiple/ duplicate entries/ correction of names etc.

For information of FD Holders and Homebuyers who have applied for Refunds on grounds of Medical Exigencies in terms of Hon’ble Supreme Court Orders dated 27.04.2022, 18.05.2022 and 17.08.2022

  1. The Lists of FD Holders who have applied for refunds on the grounds of Medical Exigencies have been uploaded on the portal and virtual hearings in those cases will continue up to 20.09.2022.
  2. The lists of Homebuyers who have applied for refunds on grounds of Medical Exigencies has been uploaded on the portal today i.e. 16.09.2022, along with the schedule of virtual hearings by Justice (Rtd.) A.M. Sapre in respect of cases mentioned in List-A.

Accordingly, the concerned Homebuyers are requested to make it convenient to attend the Virtual hearings as per the dates and time slots given in the List. The Links for the virtual hearing will be sent to them through SMS and Whatsapp on their registered phone numbers the previous day.
